"AS-IS" Service

The service is provided "AS-IS" and "AS AVAILABLE" without any warranty. We do not guarantee:

• Availability or accessibility of the service
• Error-free operation
• Permanence or security of stored data
• Accuracy of AI results
• Continuity of the service

We reserve the right to modify, restrict, or discontinue the service at any time without notice.

Using DressON requires creating a free user account. During registration you must:

• Provide truthful and complete information
• Be at least 16 years old
• Use a secure password
• Keep your access credentials confidential

You are responsible for all activities under your account.

5. Usage Rights and Obligations

Permitted Use

You may only use DressON for personal, non-commercial purposes. You use the service at your own risk.

User Responsibility

You guarantee that:

• You own all necessary rights to uploaded images
• You have obtained consent from all depicted persons
• Content does not violate third-party rights
• You will indemnify us from all third-party claims

Prohibited Actions

It is prohibited to:

• Upload illegal, obscene, or offensive content
• Use images of other people without their consent
• Abuse the service for commercial purposes
• Circumvent technical protection measures
• Overload or disrupt the service
• Use automated tools or bots
• Upload images of minors (except own with parental consent)

6. Copyright and Licenses

Your Content

You retain all rights to the images you upload. By uploading, you grant us a limited license to:

• Process your images with our AI for the sole purpose of providing the service
• Store on our servers for your personal access
• Display in your private account dashboard
• Public display: If you explicitly opt-in to the "Public Showcase", you grant us a non-exclusive, royalty-free, worldwide license to display and promote your generated try-on result on our platform.

All licenses granted are non-exclusive and royalty-free. The license for private content is strictly limited to the technical operation of the service.

Our Rights

All rights to the platform, logo, design, and software remain with us.

We are specifically not liable for:

• Accuracy, quality, or suitability of AI-generated results
• Technical disruptions, downtime, or any data loss
• Actions or omissions of third-party providers (Google, Supabase, etc.)
• Content uploaded by other users
• Economic damages or lost profits
• Consequential, incidental, or indirect damages
• Misuse of the service by third parties
• Legal violations by users
• Loss or unauthorized disclosure of data

Indemnification

You agree to indemnify and hold us harmless from all claims, suits, damages, and costs (including attorney fees) arising from your use of the service, your uploaded content, or your violation of these ToS.

Statutory Liability Limits

Liability for intent, gross negligence, personal injury, and under product liability law remains unaffected. For simple negligence, we are only liable for breach of essential contractual obligations and limited to foreseeable damages.

9. Prices and Payment

The use of DressON is currently free (testing phase). We reserve the right to offer paid premium features in the future. Users will be notified at least 30 days in advance of any pricing changes.

10. Termination and Suspension

You can delete your account at any time without giving reasons. We reserve the right to suspend, delete accounts, or discontinue the service at any time and for any reason. In case of ToS violations, we may immediately suspend your account without warning.

Upon termination of the service or your account, you have no claims to refunds, compensation, or data recovery.

11. Changes to ToS

We reserve the right to change these ToS as necessary. Changes will be communicated to you by email and take effect 30 days after notification.

12. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

13. Severability Clause

Should individual provisions of these ToS be invalid, the validity of the remaining provisions remains unaffected.
